DINGO End User License Agreement

This End User License Agreement ("Agreement") governs installation and use of DINGO - DICOM Ingest And Go ("DINGO", the "Software"). By installing, copying, accessing, or using DINGO, you agree to this Agreement. If you do not agree, do not install or use DINGO.
1. Ownership
DINGO is proprietary, copyright-protected software owned by Juan Pablo Devoto / DINGO. All rights not expressly granted in this Agreement are reserved.
This Agreement does not transfer ownership of DINGO, any source code, Docker image, release archive, binary, documentation, trademark, trade name, or other intellectual property.
2. License Grant
Subject to this Agreement and any separate written order, invoice, or license terms provided by DINGO, you are granted a limited, non-exclusive, non-transferable, revocable right to install and use DINGO for your internal on-premises PACS migration, verification, and reporting workflows.
Use of DINGO requires a valid license issued by DINGO. DINGO may prevent job creation or other operation when a valid license is not available, does not match the licensed system, has expired, has been modified, or fails validation.
3. Restrictions
You may not, and may not permit any third party to:
- copy, redistribute, publish, sell, rent, lease, lend, sublicense, or transfer DINGO except as expressly permitted in writing;
- host DINGO as a public, commercial, managed, or multi-tenant service for third parties without written permission;
- modify, adapt, translate, merge, or create derivative works from DINGO except as expressly permitted in writing;
- reverse engineer, decompile, disassemble, inspect, or attempt to derive the source code, structure, algorithms, license checks, signing keys, or protection mechanisms of DINGO, except where such restriction is prohibited by applicable law;
- bypass, disable, tamper with, remove, or misrepresent DINGO license controls, hardware identification, expiration checks, clock rollback checks, signatures, notices, or access controls;
- remove, obscure, or alter copyright, trademark, proprietary, legal, license, or attribution notices;
- use DINGO in violation of applicable law, regulation, healthcare compliance obligations, network rules, PACS policies, or data protection requirements.
4. Operational Responsibility
DINGO is a workflow tool for PACS DICOM migration, verification, and reporting. It does not replace professional judgment, clinical review, operational approval, data governance, audit requirements, backup procedures, disaster recovery planning, or independent validation.
You are responsible for:
- validating migration configuration and results;
- confirming PACS connectivity, AE Titles, routing, storage, and study counts;
- maintaining backups before and during migration activity;
- complying with applicable privacy, security, healthcare, and data protection requirements;
- deciding whether migrated, verified, or reported data is complete and usable;
- monitoring system resources, logs, and operational outcomes.
5. Third-Party Components
DINGO may be distributed or used with third-party components, tools, runtimes, libraries, base images, packages, and services, including but not limited to DCMTK, Node.js, PostgreSQL, Docker base images, and npm packages.
Those third-party components are owned by their respective copyright holders and are licensed separately under their own terms. This Agreement applies only to DINGO and does not change, replace, limit, or expand any third-party license.

Additional third-party npm package license information may be obtained from the corresponding package metadata, package repositories, and installed package license files.
6. Confidentiality and Protection
DINGO source code, obfuscated code, license generation tools, private signing keys, unpublished release materials, commercial terms, and technical protection details are confidential unless DINGO expressly states otherwise in writing.
You must use reasonable care to prevent unauthorized access, copying, disclosure, or distribution of DINGO and any license files issued to you.
7. Termination
Your right to use DINGO terminates automatically if you breach this Agreement, if your issued license expires, or if your license is revoked according to applicable written terms.
Upon termination, you must stop using DINGO and remove DINGO copies from your systems unless retention is required by law or expressly permitted in writing. Sections concerning ownership, restrictions, confidentiality, warranty disclaimer, limitation of liability, and third-party components survive termination.
8. Warranty Disclaimer
To the maximum extent permitted by applicable law, DINGO is provided "as is" and "as available", without warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, security, or uninterrupted operation.
DINGO does not warrant that migrations, verifications, reports, network operations, PACS interactions, database operations, or third-party tools will be error-free, complete, uninterrupted, or suitable for any particular clinical, regulatory, operational, or business purpose.
9. Limitation of Liability
To the maximum extent permitted by applicable law, DINGO and Juan Pablo Devoto will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, studies, goodwill, business interruption, system availability, or migration outcomes, even if advised of the possibility of such damages.
To the maximum extent permitted by applicable law, DINGO's total cumulative liability for all claims arising from or related to DINGO will not exceed the amount actually paid for the applicable DINGO license during the twelve months before the event giving rise to the claim, or USD $100 if no amount was paid.
